# The Environmental Authorisations (Scotland) Amendment Regulations 2025, Regulation 8: Amendment of regulation 5 (interpretation: authorised person)


In regulation 5 (interpretation: authorised person)—
(a) in paragraph (2)(c), in the opening words, for “the” substitute “an”,
(b) after paragraph (3), insert—
“(4) Where a person becomes an authorised person—
(a) as a result of the operation of paragraph (2),
(b) in respect of an activity which is carried on in accordance with a permit or a registration, and
(c) there is a regulatory notice, surrender notice or costs recovery notice in effect in respect of that permit or registration,
the duty to comply with the notice is transferred to that person.”.
