Paragraph 22 Existing broker and dealer registrations
An existing broker or dealer registration has effect on or after the relevant date as if it were a registration (within the meaning of the 2018 Regulations) (“a deemed registration”).
In accordance with sub-paragraph (1)—
the deemed registration is subject to the applicable standard conditions for the authorised activity of acting as a broker or dealer,
the registered broker or dealer will be treated as the authorised person in respect of the deemed registration,
the deemed registration will cease to have effect on the date three years from—
the date of registration of the existing registration as a broker or dealer under paragraph 4 of schedule 5 of the 2011 Regulations,
if the existing registration has been renewed, the date on which it was last renewed,
if at the time of the last renewal, a request was made under paragraphs 7(2) or (3) of schedule 5 of the 2011 Regulations, the date of registration as a waste carrier.
SEPA may not revoke a deemed registration under this paragraph before the date falling 6 months after the relevant date on the ground that SEPA considers that the authorised person is not in control of the carrying on of the activity.
