  "text": "The regulator must issue guidance relating to the use of non-compliance penalties and enforcement cost recovery notices specifying—\n(a) the circumstances in which they are likely to be imposed;\n(b) the circumstances in which they may not be imposed;\n(c) matters to be taken into account in establishing the amount involved;\n(d) rights of appeal.",
