# The Environmental Liability (Scotland) Regulations 2009, Regulation 19: Penalties


A person guilty of an offence under these Regulations shall be liable–
(a) on summary conviction to a fine not exceeding the statutory maximum or to imprisonment for a term not exceeding twelve months or both; or
(b) on conviction on indictment to a fine or to imprisonment for a term not exceeding two years or both.
