# The Environmental Permitting (England and Wales) (Amendment) Regulations 2009, Regulation 5: Amendment of regulation 12 (requirement for an environmental permit)


For regulation 12 (requirement for an environmental permit), substitute—
“12. (1) No person may operate a regulated facility except under and to the extent authorised by an environmental permit.
(2) Paragraph (1) is subject to the transitional provisions in regulation 71A.”.
