In section 87 (the title to which becomes “Application of enforcement powers under education legislation”)—
(a)
(b)
in subsection (2)—
(i)
for “that Act” substitute “the Education Act 1996”, and
(ii)
insert at the end “; and section 70 of the Education (Scotland) Act 1980 does not apply to the performance of a duty under that section by the proprietor of an independent school”.
