# The Financial Services Act 2012 (Consumer Credit) Order 2013, Article 6: Disciplinary measures: criminal proceedings and conviction under the 1974 Act


A person may not be convicted of an offence under the 1974 Act in respect of an act or omission in a case where the FCA has exercised its powers under section 66, 205, 206 or 206A of FSMA in relation to that person in respect of that act or omission.
