Article 52 Decision notices

it is immaterial whether the notice complies with section 388(1)(b) to (e) of the Act (decision notices)^f1, and

that section applies as if, for subsections (3) and (4), there were substituted—

“(3)

The regulator concerned may, before it takes the action to which a decision notice (“the original notice”) relates, give the person concerned a further decision notice.

(4)

A further decision notice given under subsection (3) may in particular—

(a)

relate to different action in respect of the same matter, or

(b)

vary the original notice.”.
