  "heading": "Transitional and savings provisions",
  "text": "(1) Paragraph (2) applies where, before the day on which this Order comes into force, an application for an order granting development consent for the construction or extension of a generating station which comprises, in whole or in part, an exempt electricity storage facility has been refused.\n(2) In such a case—\n(a) the provisions of the Act are to continue to apply to the refusal as if the amendments in article 3 had not been made; and\n(b) if the refusal is quashed on a judicial review, article 5(2) of this Order applies to any redetermination of the application.",
