# The Letting Agent Code of Practice (Scotland) Regulations 2016, Paragraph 59: References and checks


If you have contracted a third party to check references, or require prospective tenants to use a specific third party, the third party referencing service must not charge the tenant a fee (see also paragraphs 47 to 49 on charging fees).
