# The Public Services Reform (Scottish Water) Order 2026, Article 2: Amendment of the Water Industry (Scotland) Act 2002


(1) Schedule 3 (Scottish Water: status, constitution, proceedings etc.) of the Water Industry (Scotland) Act 2002 is amended as follows.
(2) In paragraph 2(1)(b), for “3” substitute “2”.
(3) For paragraph 2(2), substitute —
“(2) Where the number of executive members is 2, the number of non-executive members must not be fewer than 5, in accordance with paragraph 2(1).”.
(4) After sub-paragraph (2), insert —
“(2A) Where the number of executive members is 3 or more, the number of non-executive members must exceed the number of executive members by at least 2.”.
