Regulation 184 Decision on application for restoration

(1)

On an application under regulation 181(1), the court may order the restoration of a cell if—

(a)

the requirements of regulation 178 were not complied with in relation to the dissolution of the cell; or

(b)

the court considers it just to do so.

(2)

On an application under regulation 181(2), the court may order the restoration of a protected cell company if—

(a)

the requirements of regulation 180 were not complied with in relation to the dissolution of the protected cell company; or

(b)

the court considers it just to do so.

(3)

If the court orders the restoration of the cell or the protected cell company, the restoration takes effect on a copy of the court’s order being delivered to the FCA.

(4)

Where a protected cell company is restored to the register, the FCA must publish notice of the restoration of the protected cell company in the London, Edinburgh and Belfast Gazettes.

(5)

The notices must state—

(a)

the name of the protected cell company;

(b)

the protected cell company’s registered number; and

(c)

the date on which restoration took effect.
