Article 17 is amended as follows—

In paragraph 1—

(a)

omit points (a) to (e) and (h); and

(b)

for point (g) substitute—

“(g)
the Bank of England;”.

In paragraph 2—

(a)

in the first subparagraph for the words from “ESMA” to “draft regulatory” substitute “The FCA, taking into account the needs of the entities referred to in paragraph 1, may make”; and

(b)

omit the second and third subparagraphs.

In paragraph 3—

(a)

in the first subparagraph for the words from “ESMA” to “draft implementing” substitute “the FCA may make”; and

(b)

omit the second and third subparagraphs.
