# The Social Security (Personal Independence Payment) Regulations 2013, Paragraph 2


Paragraph (1)(a) does not include any person who –
(a) has previously been an insured person under Part 1 of the National Insurance Act 1965; or
(b) is paying or has previously paid one or more of the following classes of contributions under the Social Security Act 1975 or the Social Security Contributions and Benefits Act 1992–
(i) primary Class 1;
(ii) Class 2; or
(iii) Class 3.
