Rule 12 Amendment of rule 40

Rule 40 is amended as follows.

(2)

In paragraph (1), in sub-paragraph (c)—

(a)

in paragraph (i) for “or application for review” substitute “, application for review or application by the Secretary of State under Schedule 4A to the 1981 Act”;

(b)

for paragraph (ii) substitute—

“(ii)

in the case of a notice of appeal, notice of application for review or the Secretary of State’s reply, strike out that appeal, application for review or reply, as the case may be.”.
