Paragraph 9 Deemed authorisation before exit day

(1)

This paragraph applies to pre-exit aid that was existing aid in accordance with Article 1(b)(iii) of the procedural regulation (deemed authorisation by the Commission) before exit day.

(2)

The aid is deemed—

(a)

to be approved by the CMA in accordance with Article 108(3) of the TFEU; and

(b)

to be existing aid under these Regulations.

(3)

In this paragraph, “procedural regulation” means Council Regulation (EU) 2015/1589 of 13 July 2015 laying down detailed rules for the application of Article 108 of the Treaty on the Functioning of the European Union (as it had effect immediately before exit day).
