# The Transport (Scotland) Act 2019 (Consequential Provisions and Modifications) Order 2023, Article 33: Meaning of pension protection


For the purposes of article 32(2)(a) pension protection is secured for a transferring employee if, after the change in employer, the transferring employee has rights to acquire a pension which—
(a) are the same as the rights the transferring employee had as an employee of the relevant operator, or
(b) count, under article 34, as being broadly comparable to, or better than, those rights.
