# The Transport (Scotland) Act 2019 (Consequential Provisions and Modifications) Order 2023, Article 5: Investigation by the CMA


If at any time the CMA considers that the exercise or proposed exercise of a relevant function may not meet the competition test, the CMA may conduct an investigation.
