Regulation 22 Deductions from benefits

(1)

This regulation applies where—

(a)

an award of universal credit is made to joint claimants;

(b)

one of those claimants is a new claimant partner who was previously entitled to income-based jobseeker’s allowance, income-related employment and support allowance or income support (“the earlier award”), or was, immediately before termination of the award, the partner of a person who was so entitled;

(c)

the earlier award terminated by virtue of regulation 16; and

(d)

at the time at which the earlier award terminated, deductions in respect of fuel costs or water charges were being made under regulation 35 of the Social Security (Claims and Payments) Regulations 1987, in accordance with Schedule 9 to those Regulations^f1.

(2)

Where this regulation applies, deductions in respect of fuel costs or, as the case may be, water charges, may be made from the award of universal credit in accordance with Schedule 6 to the Claims and Payments Regulations, without the need for any consent which would otherwise be required under paragraph 3(3) of that Schedule.
