  "heading": "Failure to provide information under article 86 (information required where suspected failure to comply with this Order)",
  "text": "(1) The administrator may impose the penalties in paragraph (2) where—\n(a) the administrator or an authorised person has given notice to a participant in the Trading Schemes or an SPV manufacturer under article 86; and\n(b) the participant or SPV manufacturer has failed to comply with the notice by the time specified in it.\n(2) The penalties are—\n(a) the financial penalty of £750,000 or, if lower, 0.5% of the turnover of the participant in the Trading Schemes or the SPV manufacturer for its financial year ending during the scheme year to which the failure relates;\n(b) publication; and\n(c) a block.",
