  "text": "(1) The person hearing an appeal under section 43(2)(c) must make a written report to the Scottish Ministers.\n(2) A written report under paragraph (1) must include that person’s conclusions and recommendations or reasons for not making any recommendations.\n(3) Paragraph (1) does not apply if the person has been appointed to determine the appeal under section 114(1)(a) of the 1995 Act.",
