Paragraph 2 Duties of the waste regulation authority
The waste regulation authority shall discharge its specified functions, insofar as they relate to waste, with the objectives set out in sub-paragraph (2).
Those objectives are ensuring that—
the waste hierarchy set out in paragraph 6(2) and (3) is applied to the generation of waste by the holder of a permit (other than a licence under Part II of the Food and Environment Protection Act 1985 or Part 4 of the Marine (Scotland) Act 2010) in the course of any activity authorised by that permit;
waste generated by such an activity is treated in accordance with that hierarchy;
waste generated by such an activity is managed in accordance with paragraph 6(1)(a); and
Article 23(3) of the Directive is complied with.
The duty in sub-paragraph (2)(a) and (b) takes effect in relation to a permit which is in force on 27th March 2011 when that permit is next modified after that date.
