  "text": "Paragraph 49 has effect as if—\n(a) for paragraph (2)(b) there were substituted—\n“(b) where applicable (see section 23 of the 1991 Act), explain why the special administrator thinks that—\n(i) it is not likely to be possible to rescue the company as a going concern, or\n(ii) transfer is likely to secure more effective performance of the functions or activities mentioned in section 23(2)(a), (2A)(a) or (2AA)(a) of the 1991 Act.”; and\n(b) in sub-paragraph (4), before paragraph (a), there were inserted—\n“(za) to the relevant authority,\n(zb) in the case of a qualifying water supply licensee whose licence gives it a supplementary authorisation, to the Welsh Ministers,\n(zc) to the Water Services Regulation Authority,”.",
