"text": "(This note is not part of the Regulations)\nThese Regulations revoke the Regulations listed in the Schedule to the extent set out in the Schedule and amend the Education (School Performance Targets) (England) Regulations 2004 (“the 2004 Regulations”).\nRegulation 2 revokes the Education (Local Authority Performance Targets) (England) Regulations 2005 (“the 2005 Regulations”).\nThe 2005 Regulations (as amended) require local authorities to set annual targets for the educational performance of children at maintained schools. Local authorities are required to set targets relating to achievement and progression in both English and mathematics at the end of the second key stage. In addition, local authorities are required to set performance and progression targets for pupils in the fourth key stage. Targets must also be set in relation to absence, children eligible to receive free school meals, looked after children and specified ethnic groups. Targets are also required where there is underperformance within specified ethnic groups.\nThe 2005 Regulations have been amended by the Education (Local Authority Performance Targets) (England) (Amendment) Regulations 2006, the Education (Local Authority Performance Targets) (England) (Amendment) Regulations 2007, the Education (School and Local Authority Performance Targets) (England) (Amendment) Regulations 2008 and the Education (School and Local Authority Performance Targets) (England) (Amendment) Regulations 2009. These amending Regulations are revoked to the extent set out in the Schedule.\nRegulation 3 inserts new regulation 8A into the 2004 Regulations imposing a requirement on local authorities to provide a list of school targets to the Secretary of State by 31st January in the relevant school year. This replaces the duty imposed under regulation 5 of the 2005 Regulations. Regulation 3 also makes a minor amendment to regulation 8 of the 2004 Regulations, omitting an incorrect reference to regulation 4.\nNo impact assessment has been produced for this instrument because no impact on the private, voluntary or public sector is foreseen.",
