## Explanatory note

(This note is not part of the Regulations)
These Regulations replace regulation 9 of the Education (School Performance Information) (England) Regulations 1999 (“the principal Regulations”) which relate to the collection and publication of information about the performance of schools.
The substituted regulation 9 requires the governing body of every maintained school to provide the information referred to in Schedule 4 of the principal regulations directly to the Secretary of State within two weeks of receiving a written request from him. This replaces the duty under the old regulation 9 to provide that information to the local education authority, and the authority’s duty to pass this on to the Secretary of State.
The substituted regulation preserves the duty on the proprietor of a non-maintained special school or an independent school to provide the same information to the Secretary of State.
