# The Education (School Performance Targets) (England) (Amendment) Regulations 2002, Regulation 3: Amendment


(1) Regulation 3 (targets for pupils in the second key stage) shall be amended as follows.
(2) In paragraph (2) after “subject to” there shall be inserted “paragraph (3A) and”.
(3) In paragraph (3) after sub-paragraph (b) there shall be inserted before the full stop—
“; and
(c) the percentage of the relevant group of second key stage pupils to achieve level 5 or above in such tests in English; and
(d) the percentage of the relevant group of second key stage pupils to achieve level 5 or above in such tests in mathematics”.
(4) After paragraph (3) there shall be inserted—
“(3A) In relation to the targets specified in sub-paragraphs (3)(c) and (d) above, and subject to paragraph (5), for the 2001-02 school year the reference in paragraph (2) to 31st December shall be treated as a reference to 31st July.”.
(5) In paragraph (5), after “designated school,” there shall be inserted “paragraph (3A) shall not apply and”.
