# The Education (Student Support) Regulations 2007, Regulation 40: Qualifying conditions for the disabled students’ allowance


(1) An eligible student qualifies in accordance with this regulation for a grant to assist with the additional expenditure which the Secretary of State is satisfied he is obliged to incur by reason of a disability to which he is subject in respect of his undertaking a designated course.
(2) An eligible student does not qualify for a grant under this regulation unless the Secretary of State considers that he is undertaking the course in the United Kingdom.
