# The Electromagnetic Compatibility Regulations 2016, Regulation 54: Enforcement powers


(1) Part 1 of Schedule 7 (enforcement and investigatory powers conferred upon enforcing authorities and market surveillance authorities) is to have effect where the enforcing authority is—
(a) a weights and measures authority;
(b) OFCOM;
(c) the Secretary of State; or
(d) the Department of Enterprise, Trade and Investment.
(2) In addition to the powers available to an enforcing authority under paragraph (1) the authority may use the powers set out in Part 2 of Schedule 7 (compliance, withdrawal and recall notices).
