(This note is not part of the Regulations)

These Regulations are made in exercise of the power conferred by regulation 5 of the Electronic Communications and Wireless Telegraphy (Amendment etc.) (EU Exit) Regulations 2019 (S.I. 2019/246). They replace technical standards referred to in the Commission Delegated Regulation (EU) 305/2013 to include Next Generation (4G/5G) eCall and make provision for existing standards to be saved until 2G networks cease operation.

Regulation 3 amends Article 3 of the Commission Delegated Regulation (EU) 305/2013 to ensure that any eCall public safety answering point (PSAP) is equipped to handle eCalls originating from in-vehicle equipment according to the Next Generation (4G/5G) eCall standards.

Regulation 4 is a saving provision which ensures that any eCall PSAP is still required to handle eCalls originating from in-vehicle equipment according to the first generation eCall standards until 31st March 2031.

The net costs imposed on business, the voluntary sector and the public sector by these Regulations have been assessed as being less than £10m in any year and therefore a full impact assessment has not been prepared.

An Explanatory Memorandum and a de minimis assessment have been prepared and are available alongside this instrument at www.legislation.gov.uk.
