# The Energy Act 2008 (Consequential Modifications) (Offshore Environmental Protection) Order 2010, Introduction: Introductory text

The Secretary of State is designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to the environment.
Accordingly the Secretary of State, in exercise of the powers conferred by section 2(2) of that Act and by sections 104(2) and 107(2) of the Energy Act 2008, makes the following Order:
