for subsection (9) substitute—

“(9)

Except as provided for by subsections (10A) and (11), an order under this section may be made in relation to an existing combined authority only with the consent of the appropriate authorities.

(9A)

The “appropriate authorities” for the purposes of this section means—

(a)

in relation to a mayoral combined authority—

(i)

the constituent councils, and

(ii)

the mayor;

(b)

in relation to a non-mayoral combined authority—

(i)

the constituent councils, and

(ii)

the combined authority.”

for subsection (10) substitute—

“(10A)

The requirement in subsection (9) does not apply where a proposal to make the order has been submitted to the Secretary of State in accordance with section 112A (proposal for changes to existing combined arrangements - locally led).”
