# The Environment Act 1995 (Commencement No. 10) Order 1997

S.I. 1997/3044 · made 16 December 1997

Part IV of the Environment Act 1995 makes provision for local authorities to contribute to the management of air quality within their areas. This Order brings into force on 23rd December 1997 all of the provisions of Part IV which are not already in force. It also brings into force on that date section 4(4A) of the Environmental Protection Act 1990, which requires local authorities to have regard to the National Air Quality Strategy published under section 80 of the 1995 Act when exercising their powers under Part I of the 1990 Act to prevent or minimise air pollution released from processes prescribed for local control.

ENVIRONMENTAL PROTECTION
Made 16th December 1997
The Secretary of State, in exercise of his powers under section 125(3) of the Environment Act 1995, hereby makes the following Order:

## 1 Citation

This Order may be cited as the Environment Act 1995 (Commencement No. 10) Order 1997.

## 2 Provisions coming into force on 23rd December 1997

The following provisions of the Environment Act 1995 shall come into force on 23rd December 1997:
sections 82 to 86;
section 90 and Schedule 11 in so far as they are not already in force;
section 120(1) in so far as it relates to paragraph 46(5) of Schedule 22.
