Explanatory note

Article 2 of this Order brings into force on 1st November 1995 the following provisions of the Environment Act 1995—

  • section 96(1) and (5) and (6) (mineral planning permissions), Schedule 13 (review of old mineral planning permissions) and Schedule 14 (periodic review of mineral planning permissions) in relation to England and Wales;

  • section 96(2);

  • section 96(4) in so far as it relates to section 105 of the Town and Country Planning Act 1990 (reviews by mineral planning authorities) ceasing to have effect;

  • section 120(3) in so far as it relates to the repeal in Schedule 24 of the said section 105 of the Town and Country Planning Act 1990.
