  "heading": "Provisions coming into force on 1st February 1996",
  "text": "The following provisions of the Environment Act 1995 shall come into force on 1st February 1996—\nsection 5(2) and (5);\nsection 41 in so far as it confers power on the Secretary of State to make regulations and makes provision in relation to the exercise of that power;\nsection 55(7) to (10);\nsection 80;\nsections 87 to 89;\nsection 90 in so far as it relates to paragraphs 2, 3 and 5 of Schedule 11;\nsection 91;\nsection 105 in so far as it relates to paragraphs 3 and 5(1) of Schedule 15;\nsection 117;\nsection 118(1) to (3);\nsection 118(4) and (5) in so far as they confer power to make an order or make provision in relation to the exercise of that power;\nsection 118(6);\nsection 119;\nsection 120(1) in so far as it relates to paragraphs 2, 13, 36, 37(2)(b), 43, 44, 67 in so far as it confers power to make regulations or makes provision in relation to the exercise of that power, 102, 103 in so far as it confers power to issue guidance or makes provision in relation to the exercise of that power, and 232(1) of Schedule 22; and\nsection 120(3) in so far as it relates to the repeals in Schedule 24 in relation to the Local Government etc. (Scotland) Act 1994, except the repeal in relation to section 165(6) of that Act.",
