Explanatory note

Article 2 of this Order brings into force on 1st January 1997 the following provisions of the Environment Act 1995–

  • section 96(1) and (5) and (6) (mineral planning permissions), Schedule 13 (review of old mineral planning permissions) and Schedule 14 (periodic review of mineral planning permissions) in relation to Scotland;

  • section 96(3);

  • section 96(4) insofar as it relates to section 251A of the Town and Country Planning (Scotland) Act 1972 ceasing to have effect;

  • section 120(3) insofar as it relates to the repeal in Schedule 24 of section 251A of the Town and Country Planning (Scotland) Act 1972.
