  "heading": "Other emissions activities: activities not previously subject to regulation",
  "text": "(1) Subject to sub-paragraphs (3) and (4), regulation 7 of the 2018 Regulations applies to the activities listed in column 1 of Table 1 from the date specified in column 2.\n(2) An application for an authorisation for an activity listed in column 1 of Table 1—\n(a) for activities described in paragraph 1 (combustion plant generating electricity in aggregate over 1 MW)—\n(i) may only be made on or after 28 February 2028, and\n(ii) must be received by SEPA by 30 June 2028,\n(b) for any other activity listed in column 1 of Table 1 may only be made on or after the date falling 4 months before the specified date for that activity in column 2.\n(3) Where an application for authorisation is received in accordance with sub-paragraph (2), and is not determined on or before the specified date for that activity, regulation 7 of the 2018 Regulations only applies from the date the application is determined.\n(4) This paragraph does not apply to activities meeting the description of activities listed in column 1 of Table 1 where that activity is, immediately before the relevant date, subject to regulation under the 2012 Regulations.\nTable 1\nOther emissions activities in Part 3 of schedule 26 of the 2018 Regulations\nSpecified date\nActivities described in paragraph 1 (combustion plants generating electricity in aggregate over 1 MW)\n1 January 2029\nActivities described in paragraph 68 (other carbon capture activities)\n1 April 2027\nActivities described in paragraph 69 (non-waste anaerobic digestion)\n1 April 2028",
