  "text": "(1) Paragraph 8 applies to any application for a—\n(a) permit;\n(b) variation of a permit; or\n(c) surrender of a permit (in whole or in part),\nwhere any of the criteria in sub-paragraph (3) is met.\n(2) Paragraph 8 applies to a SEPA initiated variation of a permit where any of the criteria in sub-paragraph (3) is met.\n(3) The criteria are—\n(a) consultation is required by the technical schedule;\n(b) the permit or variation, where granted, will authorise for the first time, a regulated activity which is likely to cause significant environmental harm;\n(c) where SEPA determines paragraph 8 should apply having regard to the public participation statement.",
