  "heading": "Interpretation: specified activity",
  "text": "(1) A “specified activity” means a regulated activity—\n(a) first carried on, or carried on at a plant or installation that was substantially refurbished, after 30 October 2014, and\n(b) included in sub-paragraph (2) and meeting the condition in sub-paragraph (3), or included in sub-paragraph (4), subject to the exemptions in paragraph 3 of this schedule.\n(2) The activities are—\n(a) operating a large combustion plant,\n(b) waste incineration or waste co-incineration at a waste incineration plant or waste co-incineration plant,\n(c) operating a medium combustion plant,\n(d) burning any fuel in combustion plants which generate electricity on the same site with an aggregated rated thermal input of 1 MW or more as described in paragraph 1 of Chapter 1 of Part 3 of schedule 26.\n(3) The condition is that the activities in sub-paragraph (2) must—\n(a) generate electricity and have a rated thermal input exceeding 20 MW, or\n(b) where more than one activity in sub-paragraph (2) is operated in the same place, the activities must have a total rated thermal input exceeding 20 MW.\n(4) An industrial emissions activity or other emissions activity with a rated thermal input exceeding 20 MW, which—\n(a) generates waste heat at a useful temperature level, or\n(b) forms part of a new or existing district heating or cooling network.",
