Regulation 2 Application
The following provisions—
paragraph (2) of regulation 3, and
regulation 4,
apply for the purpose of determining whether an employment tribunal may make a determination in proceedings instituted on or after the commencement date (subject to paragraph (2) below).
Those provisions do not so apply if the last day on which the woman was employed in the employment falls more than six months before the commencement date.

The following provisions—
paragraph (3) of regulation 3,
regulation 5,
paragraph (4) of regulation 6, and
regulation 8,
apply in relation to proceedings instituted on or after the commencement date.
The following provisions—
paragraph (3) of regulation 6, and
regulation 7,
apply for the purpose of determining whether an employment tribunal may make a determination on a complaint presented to it on or after the commencement date (subject to paragraph (7) below).
Those provisions do not so apply if the last day of the woman’s period of service falls more than nine months before the commencement date.
