  "text": "Commission Decision\nof 26 October 2004\nlaying down detailed rules for the application of Council Directive 93/23/EEC as regards the statistical surveys on pig population and production\n(notified under document number C(2004) 4090)\n(Text with EEA relevance)\n(2004/760/EC)\nTHE COMMISSION OF THE EUROPEAN COMMUNITIES,\nHaving regard to the Treaty establishing the European Community,\nHaving regard to Council Directive 93/23/EEC of 1 June 1993 on the statistical surveys to be carried out on pig production, and in particular Articles 1(3), 2(2), 3(2), 6(1) and (2), 8(1) and 10(3) thereof,\nWhereas:\n(1)\nCommission Decision 94/432/EC of 30 May 1994 laying down detailed rules for the application of Council Directive 93/23/EEC as regards the statistical surveys on pig population and production has been amended several times.\n(2)\nPrecise definitions are required in order to carry out the surveys provided for in Directive 93/23/EEC. This requires the definition of the agricultural holdings covered by the survey. The herd size classes and regions according to which the Member States draw up the survey results at regular intervals should be determined. A single definition of carcass weight is necessary for the drawing-up of slaughtering statistics.\n(3)\nAccording to Directive 93/23/EEC, the Member States may, at their request, be authorised to carry out the April and August or May/June surveys in selected regions, on the understanding that these surveys cover at least 70 % of the pig population. Member States whose pig population makes up only a small percentage of the overall population of the Community may be authorised to carry out the survey once a year in April, May/June or November/December, or to use the regional breakdown for the final results of the April or May/June survey. Finally, the Member States may, at their request, be authorised to conduct the prescribed breakdown by herd size classes for the survey results of a given month of the year.\n(4)\nApplications have been made by the Member States for the various types of derogation.\n(5)\nBy reason of the accession of the Czech Republic, Cyprus, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia and Slovenia, it is necessary to make certain technical adaptations and to extend certain derogations to these new Member States.\n(6)\nRegulation (EC) No 1059/2003 of the European Parliament and of the Council establishes a common classification of territorial units for statistics (NUTS) for the Member States; the new NUTS nomenclature must therefore replace the previously defined regional levels.\n(7)\nDecision 94/432/EC should therefore be repealed.\n(8)\nThis Decision is in accordance with the opinion of the Standing Committee on Agricultural Statistics,\nHAS ADOPTED THIS DECISION:",
