  "text": "Commission Decision\nof 16 December 2008\namending Decision 2006/410/EC setting the amounts which, pursuant to Articles 10(2), 143d and 143e of Council Regulation (EC) No 1782/2003, Article 4(1) of Council Regulation (EC) No 378/2007 and Article 23(2) of Council Regulation (EC) No 479/2008 are made available to the EAFRD and the amounts available for EAGF expenditure\n(2008/955/EC)\nTHE COMMISSION OF THE EUROPEAN COMMUNITIES,\nHaving regard to the Treaty establishing the European Community,\nHaving regard to Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy, and in particular Article 12(2) and (3) thereof,\nWhereas:\n(1)\nCommission Decision 2006/410/EC sets the amounts which, pursuant to Articles 10(2), 143d and 143e of Council Regulation (EC) No 1782/2003 of 29 September 2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers, Article 4(1) of Council Regulation (EC) No 378/2007 laying down rules for voluntary modulation of direct payments and Article 23(2) of Council Regulation (EC) No 479/2008 of 29 April 2008 on the common organisation of the market in wine are made available to the EAFRD, and the net balance available for EAGF expenditure.\n(2)\nThe amounts for financial transfer from wine support programmes to rural development set in Article 23(2) and in Annexes II and III to Regulation (EC) No 479/2008 have been amended by Commission Regulation (EC) No 1246/2008.\n(3)\nDecision 2006/410/EC should therefore be amended accordingly,\nHAS DECIDED AS FOLLOWS:",
