Division (i) Germany undertakes to ensure that:

  1. (a)

    HRE will appoint a Monitoring Trustee to carry out the duties of a Monitoring Trustee as set out in paragraph B(ii) of this Annex; and

  2. (b)

    if the reprivatisation of PBB has not been effected by 31 December 2015, HRE will appoint a Divestiture Trustee to carry out the duties of a Divestiture Trustee as set out in paragraph B(iii) of this Annex.
