  "text": "Council Decision\nof 3 December 2012\non the position to be adopted, on behalf of the European Union, in the EEA Joint Committee concerning an amendment to Protocol 31 (on cooperation in specific fields outside the four freedoms) to the EEA Agreement\n(2012/747/EU)\nTHE COUNCIL OF THE EUROPEAN UNION,\nHaving regard to the Treaty on the Functioning of the European Union, and in particular Article 189, in conjunction with Article 218(9) thereof,\nHaving regard to Council Regulation (EC) No 2894/94 of 28 November 1994 concerning arrangements for implementing the Agreement on the European Economic Area, and in particular Article 1(3) thereof,\nHaving regard to the proposal from the European Commission,\nWhereas:\n(1)\nThe Agreement on the European Economic Area (‘the EEA Agreement’) entered into force on 1 January 1994.\n(2)\nPursuant to Article 98 of the EEA Agreement, the EEA Joint Committee may decide to amend, inter alia, Protocol 31 thereto.\n(3)\nProtocol 31 to the EEA Agreement contains specific provisions and arrangements concerning cooperation in specific fields outside the four freedoms.\n(4)\nRegulation (EU) No 911/2010 of the European Parliament and of the Council of 22 September 2010 on the European Earth monitoring programme (GMES) and its initial operations (2011 to 2013) was incorporated into the EEA Agreement by Decision of the EEA Joint Committee No 139/2012.\n(5)\nDecision of the EEA Joint Committee No 139/2012 provided for the suspension of the applicability of Regulation (EU) No 911/2010 to Iceland, until otherwise decided by the EEA Joint Committee.\n(6)\nIt is appropriate to terminate the suspension of the applicability of Regulation (EU) No 911/2010 to Iceland from 1 January 2013.\n(7)\nProtocol 31 to the EEA Agreement should therefore be amended accordingly.\n(8)\nThe position of the Union in the EEA Joint Committee should be based on the attached draft Decision,\nHAS ADOPTED THIS DECISION:",
