  "text": "Council Decision\nof 22 July 2013\non the position to be adopted, on behalf of the European Union, in the EEA Joint Committee concerning an amendment to Annex XIII to the EEA Agreement\n(2013/411/EU)\nTHE COUNCIL OF THE EUROPEAN UNION,\nHaving regard to the Treaty on the Functioning of the European Union, and in particular Article 100(2), in conjunction with Article 218(9) thereof,\nHaving regard to Council Regulation (EC) No 2894/94 of 28 November 1994 concerning arrangements for implementing the Agreement on the European Economic Area, and in particular Article 1(3) thereof,\nHaving regard to the proposal from the European Commission,\nWhereas:\n(1)\nThe Agreement on the European Economic Area (‘the EEA Agreement’) entered into force on 1 January 1994.\n(2)\nPursuant to Article 98 of the EEA Agreement, the EEA Joint Committee may decide to amend, inter alia, Annex XIII thereto.\n(3)\nAnnex XIII to the EEA Agreement contains specific provisions on all modes of transport.\n(4)\nRegulation (EC) No 1070/2009 of the European Parliament and of the Council of 21 October 2009 amending Regulations (EC) No 549/2004, (EC) No 550/2004, (EC) No 551/2004 and (EC) No 552/2004 in order to improve the performance and sustainability of the European aviation system is to be incorporated into the EEA Agreement with certain adaptations for the EEA EFTA States.\n(5)\nThe adaptations for the EEA EFTA States concern the applicability of the amendments inserted by Regulation (EC) No 1070/2009 in Articles 5, 11 and 13a of Regulation (EC) No 549/2004, Article 9a(2)(c), Article 9a(2)(i) and Article 9a(5) and (6) of Regulation (EC) No 550/2004 and Article 6(2) of Regulation (EC) No 551/2004.\n(6)\nAnnex XIII to the EEA Agreement should therefore be amended accordingly.\n(7)\nThe position of the Union in the EEA Joint Committee should be based on the attached draft Decision,\nHAS ADOPTED THIS DECISION:",
