  "text": "Council Decision (EU) 2017/783\nof 25 April 2017\non the position to be adopted, on behalf of the European Union, within the EEA Joint Committee concerning an amendment to Annex IV (Energy) to the EEA Agreement\n(Third Energy Package)\nTHE COUNCIL OF THE EUROPEAN UNION,\nHaving regard to the Treaty on the Functioning of the European Union, and in particular Articles 53(1), 62 and 114 in conjunction with Article 218(9) thereof,\nHaving regard to Council Regulation (EC) No 2894/94 of 28 November 1994 concerning arrangements for implementing the Agreement on the European Economic Area, and in particular Article 1(3) thereof,\nHaving regard to the proposal from the European Commission,\nWhereas:\n(1)\nThe Agreement on the European Economic Area (‘the EEA Agreement’) entered into force on 1 January 1994.\n(2)\nPursuant to Article 98 of the EEA Agreement, the EEA Joint Committee may decide to amend, inter alia, Annex IV (Energy) to the EEA Agreement.\n(3)\nRegulation (EC) No 713/2009 of the European Parliament and of the Council is to be incorporated into the EEA Agreement.\n(4)\nRegulation (EC) No 714/2009 of the European Parliament and of the Council is to be incorporated into the EEA Agreement.\n(5)\nRegulation (EC) No 715/2009 of the European Parliament and of the Council is to be incorporated into the EEA Agreement.\n(6)\nCommission Regulation (EU) No 543/2013 is to be incorporated into the EEA Agreement.\n(7)\nDirective 2009/72/EC of the European Parliament and of the Council is to be incorporated into the EEA Agreement.\n(8)\nDirective 2009/73/EC of the European Parliament and of the Council is to be incorporated into the EEA Agreement.\n(9)\nCommission Decision 2010/685/EU is to be incorporated into the EEA Agreement.\n(10)\nCommission Decision 2012/490/EU is to be incorporated into the EEA Agreement.\n(11)\nRegulation (EC) No 714/2009 repeals Regulation (EC) No 1228/2003 of the European Parliament and of the Council which is incorporated into the Agreement and which is consequently to be repealed under the EEA Agreement.\n(12)\nRegulation (EC) No 715/2009 repeals Regulation (EC) No 1775/2005 of the European Parliament and of the Council which is incorporated into the Agreement and which is consequently to be repealed under the EEA Agreement.\n(13)\nDirective 2009/72/EC repeals Directive 2003/54/EC of the European Parliament and of the Council which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.\n(14)\nDirective 2009/73/EC repeals Directive 2003/55/EC of the European Parliament and of the Council which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.\n(15)\nCommission Decision 2011/280/EU repeals Commission Decision 2003/796/EC which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.\n(16)\nAnnex IV (Energy) to the EEA Agreement should therefore be amended accordingly.\n(17)\nThe position of the Union within the EEA Joint Committee should therefore be based on the attached draft decision,\nHAS ADOPTED THIS DECISION:",
