  "text": "Commission Regulation (EC) No 1498/2005\nof 15 September 2005\namending Regulation (EC) No 1262/2001 laying down detailed rules for implementing Council Regulation (EC) No 1260/2001 as regards the buying in and the sale of sugar by intervention agencies\nTHE COMMISSION OF THE EUROPEAN COMMUNITIES,\nHaving regard to the Treaty establishing the European Community,\nHaving regard to Council Regulation (EC) No 1260/2001 of 19 June 2001 on the common organisation of the market in the sugar sector, and in particular Article 9(3) thereof,\nWhereas:\n(1)\nPursuant to Article 18(2) of Commission Regulation (EC) No 1262/2001, intervention agencies may require that sugar to be delivered for intervention be packed in jute bags lined with polythene.\n(2)\nNew forms of packaging for foodstuffs have been developed during the last few years. Intervention agencies that require certain of these new forms of packaging should require that such packaging complies with Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with food and repealing Directives 80/590/EEC and 89/109/EEC.\n(3)\nRegulation (EC) No 1262/2001 should therefore be amended accordingly.\n(4)\nThe measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Sugar,\nHAS ADOPTED THIS REGULATION:",
