Article 25a Regulations: the Secretary of StateF1

Regulations made by the Secretary of State under this Regulation are to be made by statutory instrument.
Except as specified in paragraph 3, a statutory instrument containing regulations made by the Secretary of State under this Regulation is subject to annulment in pursuance of a resolution of either House of Parliament.
A statutory instrument containing regulations made by the Secretary of State under Article 26 that amend Annex 2 may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.
Regulations made by the Secretary of State under this Regulation are to be made by statutory instrument.
contain supplementary, incidental, consequential, transitional or saving provision (including provision amending or revoking an enactment);
make different provision for different purposes.
In this Article, ‘enactment’ means:
where Article 25(1)(a) applies:
an enactment contained in any Order in Council, order, rules, regulations or other instrument made under an Act to the extent that the enactment applies to England;
regulations made under F2assimilated direct principal legislation to the extent that they apply in England;
F3assimilated direct minor legislation to the extent that it applies to England;
where Article 25(2) applies:
an enactment contained in any Order in Council, order, rules, regulations or other instrument made under an Act, except to the extent that the enactment extends to Northern Ireland;
regulations made under F4assimilated direct principal legislation, except to the extent that they extend to Northern Ireland;
F5assimilated direct minor legislation, except to the extent that it extends to Northern Ireland.
