Article 2

Article 1 of Regulation (EC) No 2868/95 is amended as follows:

1. 1..

   In Rule 13a(3) point (c) is deleted.

2. 2..

   Rule 23 is replaced by the following:

   ‘ Rule 23

   Registration of the trade mark

   1.

   Where no opposition has been entered or where any opposition entered has been finally disposed of by withdrawal, rejection or other disposition, the trade mark applied for and the particulars referred to in Rule 84(2) shall be recorded in the Register of Community trade marks.

   2.

   The registration shall be published in the Community Trade Marks Bulletin.’
