# Regulation (EC) No 391/2009 of the European Parliament and of the Council of 23 April 2009 on common rules and standards for ship inspection and survey organisations (Recast) (Text with EEA relevance), Article 16

Extent: E+W+S+N.I.

In the course of the assessment pursuant to Article 8(1), the Secretary of State shall verify that the holder of the recognition is the relevant legal entity within the organisation to which the provisions of this Regulation shall apply. If that is not the case, the Secretary of State shall take a decision amending that recognition.
Where the Secretary of State amends the recognition, the Secretary of State shall adapt the agreements with the recognised organisation to take account of the amendment.
