# Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (Text with EEA relevance), Article 9: Approval of an active substance

Extent: E+W+S+N.I.

1. The Secretary of State shall, on receipt of the opinion of the competent authority referred to in Article 8(4), either:
(a) issue a decision providing that an active substance is approved, and under which conditions, including the dates of approval and of expiry of the approval; or
(b) in cases where the conditions laid down in Article 4(1) or, where applicable, the conditions set out in Article 5(2), are not satisfied or where the requisite information and data have not been submitted within the prescribed period, issue a decision that an active substance is not approved.

(1A.) A decision issued under paragraph 1 is subject to the consent requirement.
2. Approved active substances shall be included in the GB List established under Article 8A of this Regulation.
